YourKind (YOURKIND PTY LTD ABN 31 663 959 448). Community Terms (October 2026).
1 Introduction
The Company provides the YourKind mobile application as part of the Platform. In addition to discovering Events and experiences and buying Tickets, an individual may use the YourKind mobile application to create a Profile, to post Highlights and Trips about the experiences they have had, to follow other Users, and to discover the Highlights of other Users and the Events and experiences available through the Platform. These Community Terms govern the use of those features.
1.1
These Community Terms form part of the Terms of Service and are incorporated into them. Each term defined in the Terms of Service has the same meaning in these Community Terms, unless it is defined differently below.
1.2
A User accepts these Community Terms by creating or using a Profile, by posting or interacting with Community Content, or by otherwise accessing or using the Community Features. A User who does not accept these Community Terms must not use the Community Features.
1.3
Where these Community Terms deal with a matter specific to the Community Features, they prevail over the Terms of Service to the extent of any inconsistency on that matter. In every other respect the Terms of Service prevail. The Acceptable Use Policy applies to all Community Content and to all use of the Community Features.
1.4
The clause of these Community Terms headed “Use of Highlights by Brands” applies to Brands. Every other clause applies to every User of the Community Features.
2 Definitions
The following terms are used regularly throughout these Community Terms and have a particular meaning:
Brand Permission means a permission given by a User, through the Platform, for a Brand to use the Community Content in an Event Highlight, as described in the clause headed “Brand Permission”.
Community Content means all content a User posts, uploads or submits through the Community Features, including Highlights, Trips, photographs, videos, titles, captions, descriptions, dates, locations, comments and the information a User adds to their Profile, and is a form of User Content.
Community Features means the features of the Platform described in these Community Terms, including Profiles, Highlights, Trips, following, Discover, and any feature that allows Users to like, comment on, share or save Community Content, as made available by the Company from time-to-time.
Discover means the part of the Platform in which the Company displays Events, experiences, Profiles, Community Content and other content to Users, by whatever name the Platform gives it from time-to-time.
Discoverable Setting means the setting in a User’s Account that determines whether that User’s Profile is a Public Profile or a Private Profile.
Event Highlight means a Highlight that relates to an Event for which the User held a Ticket.
Follower means a User who follows another User’s Profile through the Platform and, in the case of a Private Profile, whose request to follow has been accepted.
Highlight means a post a User creates through the Community Features about an event, experience, place or occasion, which may include photographs and videos, a title, a date or dates, a location and a description.
Private Profile means a Profile in respect of which the Discoverable Setting is turned off.
Profile means the profile of an individual User displayed through the Community Features.
Public Profile means a Profile in respect of which the Discoverable Setting is turned on.
Trip means a named group of Highlights created by a User.
3 Eligibility
3.1
The Community Features are available to individuals only. A Brand may not hold a Profile. A Brand is represented on the Platform by its Brand page, which these Community Terms do not govern.
3.2
Persons under 16 years of age must not create an Account or use the Community Features. The Company may take any step it considers appropriate to assess whether a User meets that requirement, and may restrict a User’s access to the Community Features, or suspend or close the User’s Account, where it reasonably believes the User is under 16 years of age.
3.3
A Profile is personal to the User who holds it. A User must not sell, transfer, license or otherwise deal in their Profile or username, and must not allow any other person to operate their Profile.
4 Profiles and visibility
4.1 Profiles
- A User’s Profile displays the User’s name and username, and may display the User’s profile photo, cover image, location, biography, the number of Highlights the User has posted, the number of countries derived from the locations of the User’s Highlights, the number of YourKind Credits the User has earned, the month and year in which the User joined the Platform, the User’s Followers, and any other information the Platform displays on a Profile from time-to-time.
- The location shown on a User’s Profile is the suburb, city or country the User enters, and the User may change it at any time.
- A User may change their username, subject to any limits the Company imposes from time-to-time. The Company may refuse, remove, reassign or require a User to change any username that the Company considers impersonates another person, infringes the rights of any person, is misleading or offensive, or has not been used for an extended period.
- The number of Followers a User has, and the list of those Followers, may be shown to other Users. The Company may, but is not obliged to, display the accounts a User follows.
4.2 Public and Private Profiles
- Every Profile is a Public Profile unless and until the User turns off the Discoverable Setting. A User may turn the Discoverable Setting on or off at any time.
- A Public Profile and the Community Content on it may be viewed by any User, may be found by search, may be displayed in Discover, and may be followed by any User without approval.
- A Private Profile may be found by search, and the information described in the clause headed “Profiles”, other than the User’s Highlights and Trips, may be shown to any User. The User’s Highlights and Trips are visible only to the User’s Followers. Another User may request to follow a Private Profile, and the request takes effect only if the holder of the Private Profile accepts it. The holder of a Private Profile may remove a Follower at any time.
- Where the Discoverable Setting is turned off, the User’s first name and profile picture are not shown on attendee lists, and the User’s Profile and Community Content are not displayed in Discover.
- Where a User changes a Public Profile to a Private Profile, every User who followed that Profile at the time of the change remains a Follower. The change does not affect any use of Community Content made, or any licence granted, before the change.
- Community Content that a User has shared, or that another person has shared or saved, may remain visible to others after the User changes the Discoverable Setting or deletes that Community Content.
5 Highlights and Trips
5.1
A User may create a Highlight about any event, experience, place or occasion, whether or not it was ticketed through the Platform and whether it took place recently or in the past. A Highlight may include as many photographs and videos as the Platform permits from time-to-time.
5.2
A User may group Highlights into a Trip. A Trip is created and held by a single User.
5.3
Where a User held a Ticket to an Event, the Platform may suggest that the User create an Event Highlight. No Highlight is posted unless the User chooses to post it. A User may post one Event Highlight for each Event.
5.4
An Event Highlight displays the name of the Event and of the Brand that listed it, and may link to that Brand’s page and to the Event. The display of a Brand or an Event on a Highlight does not mean that the Brand has reviewed, approved or endorsed the Highlight.
5.5
The User chooses the location and the date shown on a Highlight. The location may identify a specific venue or place. The User is solely responsible for deciding what location and date to disclose, including where doing so may reveal where the User is or has been. The Company is not responsible for any consequence of a User disclosing a location.
5.6
A Highlight must relate to an experience the User actually had. A User must not post a Highlight, or any other Community Content, that misrepresents the User’s own experience or that the User has been paid or rewarded to post without disclosing it as required by the clause headed “Content standards”.
6 Following and interactions
6.1
A User may follow another User’s Profile, subject to the rules for Private Profiles in these Community Terms.
6.2
Where the Platform makes it available, a User may like, comment on, share or save Community Content. A comment is Community Content of the User who posts it. A User may share a Highlight or a Trip with another person using the sharing features the Platform makes available.
6.3
A User may block another User. The effect of blocking is as described in the Platform from time-to-time.
6.4
Where the Company makes available a feature that allows a User to share Community Content to a third-party service, such as a social media platform, the Company may add to that content an overlay, frame, link or other element that includes the Company’s trade marks. The Company grants the User a limited, non-exclusive and revocable licence to share that content, with that element, to the third-party service for non-commercial purposes. The User must not remove, alter or obscure that element or use the Company’s trade marks in any other way. The User’s use of a third-party service is governed by that service’s own terms, and once content has been shared to a third-party service the Company cannot control or remove it.
7 Discover
7.1
The Company determines in its discretion what is displayed in Discover, to whom, and in what order. In doing so the Company may take into account information about a User’s location, activity on the Platform and interactions with Events, Brands, Profiles and Community Content, as described in the Privacy Policy.
7.2
Discover may include Events and experiences listed on the Platform, Profiles and Community Content of other Users, and sponsored or promoted content and advertising. Sponsored or promoted content will be identified as such where the law requires it.
7.3
The display of any Profile, Community Content, Event or experience in Discover is not a recommendation or endorsement by the Company. The Company does not verify Community Content and makes no representation about any event, experience, place or business that appears in it.
7.4
The Company is not obliged to display any Profile or Community Content in Discover, and may remove or reduce the visibility of any Profile or Community Content at any time.
8 Ownership and licence to the Company
8.1
As between the User and the Company, the User retains ownership of any Intellectual Property the User holds in their Community Content. Nothing in these Community Terms transfers that ownership to the Company or to any Brand.
8.2 Licence to operate the Platform
- The User grants the Company a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt, modify, format, translate, publish, publicly display, communicate and distribute the User’s Community Content, and to create derivative works from it, for the purposes of operating, providing, securing, promoting and improving the Platform, including displaying Community Content to other Users in accordance with the User’s settings.
- The licence in this clause ends, in respect of an item of Community Content, when the User deletes that item or closes their Account, except as provided in the clause headed “Deletion and retention”.
8.3 Use of Community Content in the Company’s marketing
- The User grants the Company a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable and sublicensable licence to use, reproduce, edit, adapt, crop, format, publish, publicly display, communicate and distribute any Community Content that is, or has at any time been, visible on a Public Profile, and to create derivative works from it, in any medium now known or later developed, for the purpose of promoting the Company, the Platform, and the Events and experiences available through it. That purpose includes use on the Company’s websites and social media accounts, in its emails and other communications, in advertising (including paid advertising on third-party services), in app store listings, and in presentations and materials provided to Brands, investors and partners.
- When the Company uses Community Content under this licence, it may display the User’s name, username and profile photo with it, but is not obliged to credit the User.
- The Company will not use under this licence any Community Content that has only ever been visible on a Private Profile.
- The licence in this clause survives the deletion of the Community Content, a change to the Discoverable Setting, the closure of the User’s Account and the termination of these Community Terms, in respect of all Community Content to which it applied before that event.
8.4 Analytics and product development
- The Company may use Community Content, including Community Content on a Private Profile, to analyse how the Platform is used, to create aggregated and de-identified information, and to develop, train, test and improve its products and services, including machine learning and artificial intelligence models, in accordance with the Privacy Policy.
8.5 No payment
- No fee, royalty or other payment is payable to a User for any use of Community Content under these Community Terms, whether by the Company or by a Brand.
8.6 Moral rights
- To the extent permitted by law, each User consents to the Company, each Brand to which the User gives Brand Permission, and each person to whom either of them sublicenses the relevant Community Content, doing or omitting to do any act in relation to the User’s Community Content that would otherwise infringe the User’s moral rights, including any right of attribution of authorship and any right of integrity of authorship. This includes publishing Community Content without attributing it to the User, and editing, cropping, adding text, graphics, music or effects to, or combining it with other material. This consent is given for the purposes of Part IX of the Copyright Act 1968 (Cth). To the extent that consent is not effective under the law of any other jurisdiction, the User waives, and agrees not to assert, any equivalent right.
9 Brand Permission
9.1
When a User posts an Event Highlight, the Platform may give the User the option to allow the Brand that listed the Event to use the photographs and videos in that Highlight. The option is not selected by default. A User gives Brand Permission by selecting it.
9.2
Where a User gives Brand Permission, the User grants the relevant Brand a non-exclusive, worldwide, royalty-free, perpetual and irrevocable licence to use, reproduce, download, edit, adapt, crop, format, publish, publicly display, communicate and distribute the Community Content in that Event Highlight, and to create derivative works from it, in any medium now known or later developed, including in paid advertising, for the purpose of promoting the Brand, its Events and experiences, and its business. The Brand may sublicense that licence to its related bodies corporate, its agencies and contractors, its collaborating Brands and venues, and to any advertising or social media service on which it publishes the content, in each case for that purpose.
9.3
The licence is granted by the User directly to the Brand. The Company is not a party to it, does not administer it, and is not liable for any use the Brand makes of the Community Content.
9.4
Brand Permission applies whether the User’s Profile is a Public Profile or a Private Profile.
9.5
Where a User gives Brand Permission, the Company may supply the Community Content in that Event Highlight to the Brand, including by making it available to download through the Brand’s dashboard, and may notify the Brand that the User has given Brand Permission.
9.6
The Brand is not obliged to credit the User or to pay the User for any use of the Community Content.
9.7
Brand Permission cannot be withdrawn in respect of Community Content that has been supplied to the Brand. A User who wishes a Brand to stop using Community Content must contact that Brand directly, and the Brand may decide in its discretion whether to do so. The deletion of an Event Highlight, a change to the Discoverable Setting or the closure of the User’s Account does not affect a licence the User has granted to a Brand. The Company is not obliged to act on any such request.
9.8
The handling of any Personal Information contained in Community Content supplied to a Brand is governed by that Brand’s own privacy policy, as described in the Privacy Policy.
10 Use of Highlights by Brands
This clause applies to Brands.
10.1
A Brand may use Community Content supplied to it under a Brand Permission only for the purpose described in the clause headed “Brand Permission”, and only in accordance with these Community Terms.
10.2
A Brand must not:
- use Community Content in a way that is false, misleading or deceptive, or that suggests the User endorses any product, service or business other than the Event or experience to which the Event Highlight relates;
- edit Community Content in a way that misrepresents the User, any other person shown in it, or the experience it depicts;
- use Community Content in a way that is defamatory, offensive or degrading to any person shown in it;
- sell, license or otherwise make Community Content available as a standalone product, including as stock content; or
- use Community Content to identify, contact, profile or target any person shown in it.
10.3
The Brand is solely responsible for its use of Community Content, including for obtaining any consent or release required by law from any person who is identifiable in it, for complying with every law, advertising code and platform rule that applies to that use, including any code restricting the depiction of persons in the advertising of alcohol, and for responding to any request or complaint about its use.
10.4
The Company supplies Community Content to Brands as provided by the User. The Company makes no representation or warranty that a User owns the Community Content, that any person shown in it has consented to its use, or that it is suitable for any purpose.
10.5
The Brand indemnifies the Company against all loss, damage, cost, expense, fine, penalty and liability the Company suffers or incurs arising out of or in connection with the Brand’s use of Community Content, including any claim by a User or by any person shown in the Community Content.
10.6
This clause survives the termination of the Brand’s account and of these Community Terms.
11 Content standards
11.1
All Community Content must comply with the Terms of Service, including the clauses headed “User conduct” and “User Content”, and with the Acceptable Use Policy.
11.2
By posting Community Content, the User warrants to the Company and to any Brand to which the User gives Brand Permission that:
- the User owns the Community Content or otherwise holds every right necessary to post it and to grant the licences in these Community Terms;
- the Community Content, and its use as permitted by these Community Terms, does not infringe the Intellectual Property, privacy or other rights of any person; and
- the User has obtained any consent required by law from any person who is identifiable in the Community Content.
11.3
A User must not post Community Content that:
- is intimate, sexually explicit or exploitative, or depicts any person under 18 years of age in a sexualised, exploitative or harmful manner;
- is violent, threatening, hateful, harassing, bullying or abusive;
- depicts or promotes illegal activity, self-harm or the use of illegal drugs;
- discloses another person’s home address, precise location, contact details or other private information without their consent;
- impersonates any person or misrepresents the User’s affiliation with any person or Brand; or
- contains malicious code or links to harmful websites.
11.4
Where a User receives any payment, free product, discount or other benefit in connection with Community Content, or posts Community Content in connection with a commercial relationship, the User must disclose that clearly in the Community Content, in the manner required by law. The Company may label, restrict or remove Community Content that does not do so.
11.5
The User indemnifies the Company against all loss, damage, cost and expense the Company suffers or incurs arising out of or in connection with the User’s Community Content or the User’s breach of these Community Terms.
12 Reporting, moderation and enforcement
12.1
A User may report any Profile or Community Content using the reporting feature in the Platform. Any person, whether or not they hold an Account, including a person who is shown in Community Content, may report Community Content by contacting the Company at support@yourkind.io.
12.2
A person who believes that Community Content infringes their Intellectual Property may notify the Company at support@yourkind.io, identifying the content, the right claimed, and their contact details.
12.3
The Company does not review Community Content before it is posted and is not obliged to monitor it. The Company may review any Community Content, by automated means or manually, at any time.
12.4
The Company may, in its discretion and without notice, remove, restrict or reduce the visibility of any Profile or Community Content, restrict a User’s access to any Community Feature, or suspend or close a User’s Account, where the Company considers that the Profile, the Community Content or the User breaches these Community Terms, the Terms of Service or the Acceptable Use Policy, may cause harm to any person, or may expose the Company to liability. The Company may close the Account of a User who repeatedly infringes the rights of others.
12.5
Where the law that applies requires it, the Company will notify a User of a decision to remove or restrict their Community Content and of the reasons for it, and will give the User an opportunity to ask for that decision to be reviewed. Subject to that, the clause of the Terms of Service headed “Lodging a Complaint” applies to every decision the Company makes under this clause.
12.6
The Company may remove Community Content, and may preserve and disclose Community Content and information about a User, where it is required or requested to do so by a regulator, a court or law enforcement, including in response to a removal notice issued under the Online Safety Act 2021 (Cth).
13 Prohibited uses of the Community Features
A User must not, and must not permit any other person to:
- use any robot, scraper, crawler or other automated means to access the Community Features, or to collect, copy or index Profiles or Community Content;
- collect or compile information about other Users, including by bulk or automated following or follow requests;
- copy, download or use another User’s Community Content outside the Platform, other than through a sharing feature the Platform makes available, without that User’s permission;
- use the Community Features to stalk, monitor or track the location or movements of any person;
- use the Community Features to advertise, solicit or sell to other Users, other than in accordance with the clause headed “Content standards”;
- create a Profile for a business, brand or any person other than the User; or
- circumvent any privacy setting, block or other restriction applied by a User or by the Company.
14 Deletion and retention
14.1
A User may delete any Highlight, Trip or other Community Content at any time. Deleted Community Content will be removed from the User’s Profile and from Discover within a reasonable time.
14.2
Deleted Community Content may persist in the Company’s backup copies for a reasonable period, and may remain visible to others where it has been shared, saved or cached, or where it has been supplied to a Brand under a Brand Permission.
14.3
The deletion of Community Content or the closure of an Account does not affect any use of Community Content made before the deletion or closure, the licence in the clause headed “Use of Community Content in the Company’s marketing”, or any licence the User has granted to a Brand.
15 Liability
15.1
Community Content is the sole responsibility of the User who posts it. The Company does not endorse, verify or guarantee any Community Content, and is not responsible for any Community Content or for any reliance placed on it.
15.2
The Company is not responsible for the conduct of any User, whether on or off the Platform, including any meeting or interaction between Users arising from the Community Features.
15.3
The clause of the Terms of Service headed “Liability & Indemnity” applies to these Community Terms and to the Community Features.
16 Changes to the Community Features
16.1
The Company may add, change, suspend or remove any Community Feature at any time, including by making a feature available to some Users only or on a trial basis.
16.2
The Company may modify these Community Terms in the same manner as it may modify the Terms of Service.
16.3
These Community Terms are effective from 1 October 2026.
End Community Terms.
